Terms and Conditions


    1. Definitions and Interpretation

    In this Agreement the following terms shall have the following meanings:

    1. “Agreement” means these terms and conditions, the Rules and Privacy Policy, collectively.
    2. “Casino Rules” means the rules of each game in winmatch Casino made available to you on the Website and/or in the “Help” section of each game.
    3. “Commercial Member” means a Member which is permitted by winmatch to access the Exchange for commercial purposes.
    4. “Exchange” means the betting exchange operated by winmatch and available on the Website.
    5. “Force Majeure Event” means any circumstance beyond our reasonable control including but not limited to: any law or any action taken by a government, regulatory or public authority; acts of God, power cut, flood, earthquake, severe weather or other natural disaster; any trade or labour dispute, strikes, industrial action or lockouts; fire or accident; terrorist attack, civil commotion or riots; non-performance by suppliers and/or contractors and/or Technical Failure.
    6. “Group” means in relation to any party, a company which is from time to time a subsidiary or the ultimate holding company of that party or another direct or indirect subsidiary of any such ultimate holding company.
    7. “winmatch” or “winmatch” means winmatch Limited, a private limited company duly incorporated in Alderney with company registration number 1827 and registered office at Inchalla, Le Val, Alderney, GY9 3UL.
    8. “ winmatch Account” means the winmatch account which a Member has opened following its successful registration with winmatch in accordance with the terms of this Agreement.
    9. “ winmatch Casino” means the online casino available on the Website.
    10. " winmatch Services" means the Exchange and/or winmatch Casino services made available by winmatch on the Website.
    11. “winmatch Website” or “Website” means the website found at, which is owned and operated by winmatch, including any other similar URLs used by the desktop and mobile versions of the Website.
    12. “Member” means a person who has successfully opened an winmatch Account.
    13. “Privacy Policy” means winmatch ’s privacy policy at https://www.winmatch .com/page/rules_and_regulations/privacy-policy/
    14. “Multiple Bets” means a single bet that is comprised of between two and ten bet selections.
    15. “Rules” mean the Market rules and Sports Rules specifically applicable to the relevant type of betting and/or gaming including any other rules available on the Website.
    16. “Technical Failure” means interruption and/or failure of communication infrastructure (including internet, telephone, communication lines); and/or failure of hardware and/or software or any other equipment.
    17. “We/ us/ our” means, as appropriate, winmatch or winmatch ’s.
    18. “You” means any user of the Website and/or Member of the Exchange. 

    1. Becoming a Member of the Exchange and winmatch Casino

    2.1 You may not use the Exchange and/or winmatch Casino unless and until you have successfully opened a winmatch Account. You can open a winmatch Account by completing the registration page on the Website.

    2.2 You will only be deemed to have successfully opened a winmatch Account once you have:

    • accurately and fully completed the registration page on the Website or you have applied offline through one of our approved agents (not available to customers in Great Britain).
    • accepted the terms of this Agreement; and
    • been issued by us with a member username and password.

    2.3 All applicants must be over 18 years of age and of legal capacity or the age of majority in their jurisdiction (whichever is the highest) to register with winmatch and use our services.

    2.4 In order to carry out its regulatory obligationswinmatch may be required to obtain (a) proof of identity document (such as passport or ID); (b) proof of residential address (such as utility bill or bank statement); and (c) as well as other documents as reasonably required bywinmatch including documents to evidence your source of wealth and/or source of funds. Please note that you will not be able to deposit funds in your winmatch Account until we have carried out any age verification checks.  

    2.5 You are responsible for determining whether your access and/or use of the Website and/or the winmatch Services is compliant with applicable laws in your jurisdiction and you warrant, undertake and represent to us that gambling is not illegal in the jurisdiction where you reside.

    2.6 All information supplied to winmatch whether via the Website and/or otherwise must be your information and be accurate and complete in all respects. The name and address on your winmatch Account must match with your true name and identity and with the name on your credit card and/or other payment accounts used to deposit monies into your winmatch Account. Please note that we may need to notify the relevant regulatory authorities, public bodies and/or the police if we discover that we may have been provided with false information.

    2.7 Members can select their own username and password for their winmatch Account; however, such information must not be shared with any third party. You should immediately change your login details if you become aware that a third party is aware of your login details. Should you forget your login details and/or if you are experiencing any issues with resetting your login details please contact Customer Services. winmatch will not be liable for any loss, costs and expenses that you have incurred or suffered as a result of any unauthorised use or misuse of your login details.

    2.8 We may, in our absolute discretion, refuse to accept your application for membership of the Exchange and/or winmatch Casino for whatever reason. We shall not be obliged to furnish you with any reasons for such refusal.

    2.9 You can select the preferred currency of your winmatch Account from the available currencies available on the Website. You understand that you will not receive any interest on your deposited funds, winnings or on any outstanding amount(s) in your winmatch Account, and you shall not treat winmatch as a bank or other financial institution.

    2.10 Customers in Great Britain will be able to have access to a minimum of 3 months of account activity and gambling history via your winmatch Account, and you will be able to request account and gambling history up to a period of 12 months. Please contact our Customer Services for further information.

    1. Your Representations and Warranties

    3.1 You hereby warrant, represent and undertake (and the opening and operation of the winmatch Account is based upon such representations and warranties) that:

    • you are fully and legally entitled to enter into this Agreement.
    • your entering into this Agreement is not illegal in your jurisdiction of residence.
    • you will not use the Exchange and/or winmatch Casino while located in any jurisdiction that prohibits the use of such services.
    • you are 18 years of age or the age of majority for engaging with our services under the laws of the jurisdiction in which you are located while using the Website, whichever is the highest.
    • at the time of the opening of your winmatch Account you are not a Politically Exposed Person (PEP) and at any time thereafter you shall notify us immediately if you are a PEP.
    • if you are a professional sportsperson you shall adhere to all rules and regulations relating to gambling that may be issued by the governing authority of your sport.
    • unless otherwise agreed by us in writing, you are acting as a principal and not as an agent on behalf of a third party.
    • you will not use your winmatch Account in order to place bets and/or use the winmatch Casino on behalf of a third party.
    • all details provided by you are accurate and you will not take any steps to conceal your true identity from the Exchange and winmatch Casino by, for example, including but not limited to using pseudonyms, false addresses and/or taking technical steps to conceal your identity and/or location.
    • you have not used a third party’s personal data to open the winmatch Account.
    • you are the rightful owner of the money which you at any time deposit in your winmatch Account.
    • you are not a self-excluded individual.
    • you are not registered with any national self-excluded scheme including but not limited to Gamstop.
    • you have not already had a winmatch Account closed by us.
    • you are the owner of any credit card, debit card and/or any other permitted payment method you use for the winmatch Services.
    • all and any monies utilized by you on the Website and use of the winmatch Services are the proceeds of and/or derived from lawful activities.

    3.2 A Member is not to attempt to execute trades from one specific account to another (i.e. "pass-through" or "dump" trades) - particularly if the intention is simply to move funds from one Member’s winmatch Account to another Member’s winmatch Account.

    1. winmatch Exchange

    4.1 winmatch provides a platform upon which you can enter into various betting transactions in relation to the markets available on the Website ("Markets").

    4.2 You can enter into betting transactions either:

    • on the Website.
    • by the Application Programmers Interface ("API").
    • through one of our approved agents (not available to customers in Great Britain); or

    4.3 winmatch is made available to its Members for recreational betting and gaming purposes only and access is granted to the Exchange at winmatch ’s sole discretion.

    4.4 winmatch reserves the right to suspend or terminate a winmatch Account where it suspects that the winmatch Account is being used for commercial purposes without winmatch ’s approval, or where the winmatch Account is considered attritional to the Exchange ecosystem.

    4.5 winmatch shall notify a Member that winmatch has determined that their winmatch Account is being used for commercial purposes, and as such they have been classed as a Commercial Member.


    We provide an API that allows authorised API users to access the functionality of the platform without having to necessarily go via the URL winmatch .com in a browser.

    Use of these API endpoints and indeed any interaction with the winmatch platform and its various services in an automated way (e.g. not by a human operator) is only permitted where API users have completed the  API Usage Inquiry Form and undergone an authorisation process and where winmatch has given express permission for the customer to operate in this way. winmatch shall have total discretion as to which customers are permitted access to the API.

    5.1 Authorisation

    The API is made available to authorised API users solely to permit access to the winmatch exchange platform enabling API users to view market prices and place bets on their account. Any other use of the API is strictly forbidden (examples of prohibited activities may include: odds scraping, browser impersonation, browser automation, any attempt to avoid or camouflage direct consumption of the API, any attempt to reverse engineer or probe the functionality of the winmatch exchange platform).

    Any unauthorised use of the API or any other attempt to interact with the website in a non-standard way, for example through the use of web scraping techniques, browser impersonation or browser automation, or any other attempt to avoid or camouflage direct consumption of the API are expressly forbidden. Equally, any attempt to reverse engineer or probe the internals of the website are forbidden. Such actions may result in the cancellation of trades and the immediate suspension or closure of your winmatch Account.

    winmatch takes the security and integrity of its exchange platform very seriously and in the event that winmatch recognises or suspects that its API is being used other than in accordance with this authorisation, winmatch may take immediate action to protect the exchange and its customers. Such action may include immediate suspension of your account, the suspension of markets, the cancellation of any trades and/or injunctive relief via the courts.

    5.2 Ongoing Requirements

    As part of the permission to use the API you agree to provide us with current information about your specific technical setup and how exactly you intend to access and interact with the winmatch platform. Failure to do so will result in us not granting or withdrawing the permission and may result in your account being closed without notice.

    In the event that any of this information changes, you are required to keep winmatch updated of any changes.

    5.3 Restrictions

    API usage comes with additional restrictions and may involve additional charges.

    You may only use the API for markets that have been agreed to and cleared for you to use by winmatch . Under no circumstance are you to use the API in ways that is not agreed to explicitly by winmatch.

    You may not forward, sell or otherwise distribute any information coming out of the winmatch platform to third parties. Information in this context includes but is not limited to: market data (such as prices and market statuses), event and event participant information or other business related information.

    You may not use the API, and any data derived from the consumption of it, to benchmark or compare winmatch’s products, markets, prices and liquidity or its technical systems in the public domain.

    As part of your API authorisation you will receive limits as to how many calls you are allowed to make in a given time period. Exceeding these pre-agreed limits may result in your API access being suspended or revoked blocked temporarily or in the case of repeat offenses, indefinitely.

    winmatch will not be responsible for any adverse consequences (such as a loss, damage or third-party claim) you may suffer as a result of such action as a temporary or permanent block to our APIs.

    winmatch reserves the right to disallow API access for any reason and at any time.

    5.4 Charges

    Each set of 1 million READ requests in a calendar month will be charged at 100 GBP (depending on account currency - if you have an account in a different currency then the rate will be converted from GBP at the prevailing market rate).

    WRITE requests are not chargeable, assuming that they are made at reasonable frequency. As part of the onboarding process, winmatch will ascertain the appropriate frequency as mentioned in section 5.3.

    We recommend that API  users monitor and keep a record of their API usage. Note that winmatch ’s determination of your usage shall be final and binding.
    winmatch are not responsible for providing users with their API usage.

    Naturally, non-payment of API charges will lead to immediate suspension of your account.

    1. Fees and Withdrawals

    6.1 All withdrawal and deposit requests should be submitted via the deposit/withdraw page of our Website.

    6.2 winmatch may charge a processing fee if your deposit and/or withdrawal activity does not correspond to a sufficient volume of play. You are responsible for paying the fee to us, either on demand and/or where there are sufficient funds in your winmatch Account by debiting these charges from such funds in your account. We will notify you of the amount of fee payable to us prior to being deducted from your winmatch Account. This does not affect your right to withdraw all or part of your deposited funds or your winnings at any time, less any outstanding fees and/or charges.

    6.3 winmatch (acting reasonably) reserves the right to: (a) limit the number of deposits (whether monthly, weekly or otherwise) via a certain payment method at any time upon notice; and/or (b) request you to cease use of a certain payment method altogether if it is detrimental to the conduct of winmatch ’s business and/or if your deposit and/or withdrawal activity does not correspond to a sufficient volume of play.

    6.4 winmatch customers located in the United Kingdom, Isle of Man, Channel Isles and Ireland shall be charged a two percent (2%) commission rate on net profits (excluding enhanced special markets), all other customers shall be charged a four percent (4%) commission rate on net profits (excluding enhanced special markets). All winmatch customers will be charged a five percent (5%) commission rate on net profits for Enhanced special markets. For further information on net win, please see our FAQ at

    6.5 Commercial Members are subject to additional fees which may include:
    · “Transactional Rate” – This is a fee which is calculated as a percentage of each bet placed on the winmatch Account; and/or
    ·“Market Commission Rate” – This is a fee applicable to certain betting markets which is calculated as a percentage of gross profit generated by the Commercial Member on those markets. (Gross profits is calculated as the total amount won on the exchange, less the total amount lost); and/or
    · “Revenue Share” – This is a fee applicable to certain betting markets which is calculated as a percentage of net profits generated by the Commercial Member on those markets. (Net profits is calculated as the total amount won on the exchange, less: (i) the total amount lost, and (ii) commission paid).
    (These fees are individually and/or collectively referred to as “ winmatch Rates”)

    6.6 Commercial Members shall be notified of the winmatch Rates which will be applied to their winmatch Account going forward. Members which do not wish to be subject to the winmatch Rates, may cease trading on the exchange and/or close their winmatch Account(s).

    6.7 Where the Commercial Member holds multiple winmatch Accounts, these will be grouped together for the purposes of calculating the winmatch Rates and all winmatch Accounts shall be jointly and severally liable for the payment of any winmatch Rates which are payable.

    6.8 The Transactional Rate and Market Commission Rate are paid immediately on market settlement. The Revenue Share shall be payable on the first business day of the following month and winmatch shall automatically deduct/withdraw such sum directly from the winmatch Account(s). In the event that there are insufficient funds held on the winmatch Account(s), winmatch reserves the right to: (i) suspend the Commercial Member, and/or (ii) withhold any withdrawal of all funds, pending payment in full of any outstanding balance.

    6.9 Only cleared funds are available for withdrawal; funds linked to open positions or to recent credit-card deposits are not classified as "cleared". The "account summary" on the winmatch Account provides an up-to-date view of your cleared balance. Only funds listed as “available to bet” should be considered cleared.

    6.10 Please send an email to accounts@ to request a withdrawal which cannot be requested via the deposit/withdrawal page of our Website.

    1. Casino

    7.1 You are responsible for reading the Casino Rules which are hereby incorporated as part of this Agreement. Playing a game in winmatch Casino constitutes your acceptance of the Casino Rules. Should you object to the Casino Rules of a game then you should not play that game and contact Customer Services where appropriate.

    7.2 The casino games available on the Website have been independently certified and approved by a third-party testing house in accordance with the approved standards of the Alderney Gambling Control Commission and/or the UK Gambling Commission (as applicable) except as indicated otherwise on the Website.

    7.3 You can play on the winmatch Casino for fun (or free play game) only when you create your winmatch Account.

    7.4 All winmatch Casino games are non-refundable and non-cancellable, meaning that where you play a game with real money, money will be withdrawn from your winmatch Account instantly following each instance of game play.  

    7.6 From time to time, you may be eligible for bonus funds up to a certain amount for which wagering requirements shall apply before you are entitled to withdraw any such bonus funds or winnings. These wagering requirements will be notified to you upon you participating in a promotion or upon bonus funds being otherwise awarded to you. Should you wish to make a withdrawal before the wagering requirements have been fulfilled, we shall deduct the whole amount of bonus funds as well as any winnings before authorising the withdrawal. Certain limitations or restrictions may be applied to promotional schemes and these shall be notified to you in  the terms of the relevant promotion.     7.9 Should a winmatch  Casino game be interrupted due to a Technical Failure, that winmatch Casino game may resume from the position where the disruption took place when you next log onto winmatch  Casino  The game will be paid as normal and if your bet wins your winnings will be paid into your winmatch Account (or alternatively your losses will be deducted). Your game history will allow you to see what the result of the game and your bet was. Alternatively, for certain winmatch Casino games, the games may not resume from where they were interrupted, in which case your balance will usually update with the result of any activity in relation to these winmatch Casino games. However, on some occasions, the winmatch Casino database may fail to transfer the result of the game and therefore you would not know the result of the game; in such circumstances, winmatch Casino may void the game or, in our discretion, we may award you with the winnings you may have won.

    7.10 In the event of human error relating to the generation of any result, bet settlement or any other element of a game, winmatch will not be liable to you as a result of any such errors and we reserve the right to withhold payment and to declare all bets or plays in question void.   If the error is discovered after payment has been made, you shall indemnify and shall be liable to pay us, on demand, the relevant amount paid by us to you as a result of the error.

    7.11 In the unlikely event that there is any malfunction of  a winmatch   Casino game that produces an obviously erroneous outcome, any wager placed and the outcomes of any such wager shall be considered void in respect of that wager. All wagers shall be refunded to your ') }} winmatch Account, and any purported winnings shall be void. winmatch excludes all further liability for any such malfunction.

    1. Jackpots

    8.1 We may choose to make available to our customers pooled progressive jackpot games. The jackpot games are owned and operated by winmatch and/or its third-party suppliers (as applicable).

    8.2 All Network Jackpot winnings will be subject to our confirmation.

    8.3 Upon a Network Jackpot Game being won, winmatch will as soon as reasonably practicable verify and validate the exact Network Jackpot Winning amount. In the case of the Network Jackpot Game being provided and managed by a third-party operator, this amount will be validated by the third-party supplier. Once verified, the player will be notified of its Network Jackpot Winnings by winmatch (“Jackpot Winning Notification”). The Network Jackpot Winnings will be transferred to the players winmatch Account within a period of 10 days from the date of the Jackpot Winning Notification. Payment of the Network Jackpot Winnings to the player shall be paid in one single payment and the player acknowledges that any applicable taxes and fees in connection with any Network Jackpot Winnings awarded  is  the sole responsibility of the player.

    1. winmatch Exchange -  Cancelling Offers, Voiding of Pay and Plays and Suspension of Markets

    9.1 All offers placed are immediately binding on Customers at the point at which the bet is offered on the winmatch exchange platform. Offers can be recalled, up until the point at which the offer is matched by another participant. At this point the bet is officially struck.

    9.2 winmatch reserves the right to cancel any/all open offers, void any/all matched bets and/or suspend any/all markets where it determines that there has been a palpable error, a mistrade, market abuse, market manipulation, suspected or attempted fraud, suspected illegal activity or for any other reason where winmatch deems it is required to adhere to its regulatory obligations.

    9.3 winmatch reserves the right to cancel any/all open offers, void any/all matched bets and/or suspend any/all markets in the event that the winmatch Website becomes unavailable for trading for whatever reason. By way of example, this may be caused by third-party cyber / DDOS attacks, server failure resulting in unscheduled downtime or intervention by winmatch and/or a regulator where such intervention is required to ensure compliance with applicable laws / regulations / codes of practice / regulatory guidance. In certain cases winmatch may reopen markets under a ‘trade at your own risk’ status.

    9.4 Where a Customer becomes aware of a trading error on the winmatch exchange platform, it is their responsibility to report this to winmatch without delay, setting out the details of the error. winmatch will then examine the facts of the case and, acting in its sole discretion, make a final determination to either void the bet and refund all affected customers, or to allow the bet to stand and settle the bet in accordance with the Market Rules.

    9.5 winmatch shall not be liable to you for any loss, damages, costs and expenses incurred or suffered as a result of winmatch taking a decision to either cancel/not cancel open offers, or void/not void bets, or suspend/not suspend any/all markets

    1. Cash Out

    10.1 These terms and conditions apply when a Member uses winmatch’s cash out feature (“Cash Out”). These terms and conditions should be read in conjunction with winmatch’s Market Rules and Sports Rules

    10.2 Cash Out is offered to markets on the winmatch Exchange and does not apply to winmatch Casino. The Cash Out feature allows a customer to lock in profit or reduce exposure on a runner early before the event finishes.

    10.3 Where Cash Out is available on a market a Cash Out indicator will be displayed next to a runner. If the Cash Out indicator is not displayed next to a runner then Cash Out is not available. winmatch customers should not assume that Cash Out will be available once a bet is placed.

    10.4 winmatch’s Cash Out will attempt to cash a Member out of their current position on a runner. Any other bets on the market on other runners will be unaffected by a Cash Out request, except in the case of a market with 2 runners only. If a market has 2 runners only, the Cash Out feature will attempt to exit all of a Member’s positions on a market.

    10.5 When Cash Out is selected winmatch will calculate in real time how much money is available for a Member to cash out based on the liquidity in the market on the winmatch Exchange. If the market moves and/or there is any other change in a market, then the amount displayed may change.

    10.6 The Cash Out value displayed on your winmatch account page is the minimum amount you will receive if you were to make a successful Cash Out. All bets will be paid to your winmatch Account when the market is settled.

    10.7 If you request to Cash Out and the Cash Out value has changed unfavourably (for example due to a change in the market) then your Cash Out request will be unsuccessful, and you will not be able to Cash Out and the Cash Out value will be adjusted accordingly. If the market moves favourably then, the Cash Out value available to you will be adjusted and you will be able to cash out.

    10.8 If a Cash Out request is successful a message will be displayed and all open offers on a runner you are cashing out will be cancelled.

    10.9 Cash Out requests made in-play are subject to the normal in-play delay on the market as set out in the Market Rules.

    10.10 winmatch reserves the right to withdraw, disable and/or suspend the Cash Out feature and/or any Cash Out offers at any time and for whatever reason.

    10.11 winmatch is not liable if Cash out is not available including without limitation for Technical Failure for any other reason whether in winmatch’s control or not.

    10.12 winmatch does not guarantee the availability of Cash Out nor does it guarantee that a cash out request will be accepted and therefore a cash out request may be unsuccessful.


    1. Multiple Bets

    11.1 For the avoidance of doubt, the terms of this Agreement and Rules available on the Website shall apply to all Multiple  bets. Please see our FAQ at for further information.

    11.2 If a selection in a Multiple Bet is a non-runner or a voided bet as per the Market Rules, Sports Rules and/or this Agreement then all bets on that leg of the Multiple  Bet will be void and the Multiple  Bet may be adjusted accordingly. For example, a treble becomes a double; a double becomes a single etc.

    11.3 Certain combinations of bet selections (including related contingencies) are not accepted and attempts to place such bets may be prompted with an error pop-up at the Multiple  Bet submission stage. If a bet of this type is accepted in error for whatever reason including Technical Failure, winmatch reserves the right to void the relevant individual bet combinations.

    11.4 You acknowledge and agree that:

    • once a Multiple Bet is submitted you will not be able to cancel or withdraw it for any reason;
    • For one section of your Multiple bet to win, all selections in that section must win, for example at least two selections in a "Yankee" must win in order to win 1 x double
    • the maximum payout (that is winnings excluding original stake) per complete Multiple  Bet is USD$10,000;
    • The cash out tool is not available for Multiple Bets; and
    • winmatch’s Multiple Bets tool is not available to API customers and therefore any Multiple bets submitted by API customer’s will be voided.

    11.5 winmatch reserves the right to:

    • void an Multiple  Bet in the case of any obvious error (as determined by winmatch );
    • void any or all bets within an Multiple  Bet made by any Customer acting in an attempt to defraud winmatch or any Customer of winmatch. For example, if winmatch has a suspicion or any evidence of price, match or event rigging and/or if there is a breach or attempted breach of any rules issued by the applicable sport’s governing body. Where there is a reasonable suspicion or evidence of rigging or some other act which has unfairly affected the result, or where there is evidence of a series of bets each containing the same selection(s) having been placed by or for the same individual or syndicate of individuals, winmatch reserves the right to make bets void or withhold payment of returns pending the outcome of any subsequent investigation.
    • select which markets will be available for an Multiple Bet.
    • add, change and/or withdraw any markets available for an Multiple bet at any time; and
    • withdraw or limit the availability of Multiple bets at any time from any customer who is in breach of any term of this Agreement, Sports Rules and/or Market Rules or for any other reason as determined by winmatch in its sole discretion (acting reasonably).  

    11.6 winmatch does not warrant, represent nor undertake that its  Multiple Bet tool will be available at all times, nor that it will operate uninterrupted or error-free.

    1. Suspension and Termination of a Members Account

    12.1 We reserve the right to suspend and/or terminate your winmatch Account and/or cancel any unmatched offers at any time should one or more of the following event(s) occur (including without limitation):

    • we suspect that any Member(s) are acting other than on their own behalf and/or otherwise in concert with others and/or engaging in illegal and/or fraudulent activity while using the winmatch Services.
    • where a Member is suspected and/or   known to have carried out and/or participated in any activity that results in some form of manipulation of the winmatch Services (including without limitation): trap offers, any activity which results in manipulation of time and speed in respect of the winmatch Services.
    • if a Members is in breach of any terms and conditions of this Agreement.
    • where it is suspect, or it is illegal for a Member to participate in the winmatch Services.
    • where we have not been able to complete the verification of your winmatch Account and/or we have a reason to believe that the information provided to us is inaccurate.
    • where we have a reason to believe you have been engaged and/or aware of match-fixing, collusion or any other form of cheating.
    • if you have commenced bankruptcy proceedings and/or became bankrupt or entered into any analogous proceedings anywhere in the world.
    • if we suspect you are self-excluded or if we suspect that you have a problem with your gambling; and
    • where we are required to do so in accordance with applicable law including any regulations issued by a regulatory authority or otherwise in any jurisdiction.

    12.2 If we terminate your winmatch Account in accordance with this Clause 12, we reserve the right to cancel any matched and/or unmatched bets and/or withhold any winnings except where it shall be unlawful for us to do so.  

    12.3  Provided that your winmatch Account is not in the negative balance and/or no money is due to us, you are entitled to close your winmatch Account and terminate this Agreement by providing us no less than 24 hours’ notice to us at any time, by contacting us through our Customer Services or by closing your winmatch Account.

    13.1 We are required by our licence to inform customers about what happens to funds which we hold on account for you in the event of insolvency

    13.2 We hold customer funds separate from company funds in a mixture of bank accounts and in reserve funds which we hold with our payment processors.     1. Complaints

    16.1 If you have a complaint about any aspect of the general conduct of winmatch’s licensed activities, the matter will be processed in accordance with our internal complaint’s procedure.

    16.2 Where the complaint refers to the outcome of a gambling transaction and is not resolved to your satisfaction following our internal procedure, the matter will be categorised as a “dispute” and may be referred to independent dispute resolution service as outlined below.

    16.10 An advisor will log your call/message, investigate your enquiry and respond to it.     1. Your Indemnities

    19.1 You agree to indemnify winmatch from any liabilities, damages, claims, losses and reasonable legal costs suffered or incurred by winmatch arising out of or in connection with any breach of this Agreement by you.

    19.2 You agree to indemnify us for any losses, reasonable costs or expenses which may be incurred by us as a result of any intentional errors contained in instructions submitted by you, any unauthorised or unlawful use of the winmatch services or any payment card charge-backs which may be effected due to you acting fraudulently  on amounts transferred by you to your winmatch Account.

    1. Limitation of Liability

    20.1 Any use of the contents and any other information available on the Website shall be at your sole option, discretion and risk. winmatch shall not be liable to you for any misuse of the contents or information on the Website by you or by a third party.

    20.2 Live score data offered on selected events on the Website may be subject to a delay and occasionally may be inaccurate. The data is supplied "as-is" without any express or implied warranty of any kind. In no event shall we be liable for any damages whatsoever including without limitation damages for loss of direct or indirect profits, economic loss, business interruption, loss of information or any direct, indirect, consequential, punitive, special, exemplary or special losses and/ or damages however caused including but not limited to any loss of contracts, loss of goodwill and loss of reputation arising out of the use of or inability to use the data provided by the live score functionality.

    20.3 We shall provide the winmatch services with reasonable care and skill and substantially as described in this Agreement. We do not make any other promises or warranties about the services.


    20.5 winmatch’s maximum liability to you or any third party howsoever arising out of this Agreement or your use of the Website whether for breach of contract, tort (including negligence) or otherwise, shall be limited to the amount of commission received by us from you in the 6 (six) month period prior to the cause of action arising.

    20.6 Nothing in this Agreement will operate so as to exclude any liability which we may have in respect of: (a) fraud (including fraudulent misrepresentation); or (b) death or personal injury caused by our negligence.

    1. Force Majeure

    21.1 Without prejudice to the laws and regulations where winmatch is licensed, we shall not be in breach of this Agreement and/or otherwise liable if we are prevented, hindered and/or delayed in and/or from performing any of our obligations under this Agreement due to a Force Majeure Event.  

    21.2 During a Force Majeure Event, we may at any time cancel, terminate and/or suspend the winmatch Services (with or without notice) without incurring any liability.

    21.3 We will not be liable for the failure of any equipment or software, wherever located or administered, or whether under our direct control or not, that may prevent the operation of the winmatch Services, impede the matching of offers, or prevent Members from being able to contact us.

    21.4 If the Website is made unavailable for whatever reason including due to a Force Majeure Event or unplanned maintenance, we shall honor in full matched bets and in the case of unmatched bets your stake shall be returned to you.     21.5 Additionally, please note that if you place a bet with the intention to subsequently place a separate bet(s) to increase and/or reduce liability incurred by the initial bet (whether on the winmatch Website and/or on a third party website or otherwise) there cannot be a guarantee that the Website will be available at the point you wish to place the bet.

  • 22.1 Key Account Programme: Membership to our Key Account  programme is by invitation only and at winmatch’s sole discretion. Your status as a member of our key Account  Programme may be altered by us at any time.

    22.2 The English language version of this Agreement will prevail over any other language version which we may issue from time to time.

    22.3 Your winmatch Account is made available by winmatch and the customer services will be provided by a Group company of winmatch.

    22.4 Your personal data will be processed in accordance with our Privacy Policy.

    22.5 Employees of winmatch and its Group are not permitted to open an winmatch Account for their personal use.

    22.7 We may change the terms and conditions of this Agreement from time to time for whatever reason (including to comply with applicable laws and regulations, and regulatory requirements). Any minor or insubstantial changes or any amendments made for clarification purposes or correction of any typos may be made by us at any time and you are advised to review the terms of this Agreement on a regular basis. Any material changes will be notified to you prior to the changes coming into effect. If any change is unacceptable to you, you should immediately cease using the Website and/or close your winmatch Account. If, however, you continue to use the Website and/or winmatch Account after the date on which the changes to this Agreement come into effect, you will be deemed to have accepted those changes.

    22.6 Abusive or offensive language will not be tolerated on our chat boards, social media accounts or otherwise with winmatch s’ or its Group staff. winmatch reserves the right to: (a) suspend and/or terminate a Member’s winmatch Account at any time (with or without notice) if a Member uses abusive or offensive language to any of winmatch’s or its  Group company staff; and (b) to remove or delete any abusive or offensive content including but not limited to texts, posts, photos, files, images and videos from its Website and social media accounts (to be determined by winmatch in its sole and absolute discretion).

    22.8 If any provision of this Agreement is determined by any court or administrative or regulatory body or any other competent authority to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this Agreement which shall remain in full force and effect.

    22.9 If we fail to insist upon strict performance of any of your obligations or if we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of the provisions of this Agreement shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

    22.10 Unless the terms and conditions of this Agreement state otherwise: (a) the Contracts (Rights of Third Parties) Act 1999 shall not apply to this Agreement; and (b) all third-party rights in any jurisdiction are hereby excluded to the fullest extent permitted by applicable law.

    22.11 Notices and other communications delivered or mailed by winmatch to the postal address or to the  electronic-mail  address provided by the Member shall, until winmatch has received notice in writing of any different address, be deemed to have been personally delivered once sent whether actually received or not.

    22.12 We may assign our rights and sub-contract our obligations under this Agreement to any of our Group companies without giving notice, or to any other third party upon prior written notice.

    22.13 Nothing in this Agreement shall create or be deemed to create a partnership, joint venture or principal-agent relationship between the parties and no party shall have authority to bind the other party in any way.  

    1. Governing Law and Jurisdiction

    23.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales excluding its conflicts of law rules. You hereby irrevocable agree that the courts of England and Wales shall have exclusive jurisdiction.

    All Other Customers

    23.2 This Agreement shall be governed by and construed in accordance with the laws of Alderney excluding its conflict of law rules. You hereby irrevocably agree that the courts of Guernsey shall have exclusive jurisdiction.
